NYC Sidewalk Repair Laws: What Every Property Owner Needs to Know

Many property owners in New York City are surprised to learn that the sidewalk in front of their building isn't the city's responsibility to fix — it's theirs. Under New York City's Administrative Code, property owners are legally required to maintain the sidewalk abutting their property in a safe, code-compliant condition, and violations carry real financial consequences.

Who's Actually Responsible

Section 7-210 of the NYC Administrative Code places sidewalk maintenance liability on the property owner, not the Department of Transportation (DOT). That means if a defect causes an injury — a trip-and-fall, for example — the property owner can be held liable, not the city, with limited exceptions for one-, two-, and three-family owner-occupied homes.

What Counts as a Violation

DOT inspectors look for specific, measurable defects, not general wear. Understanding these thresholds helps you catch problems before an inspector does.

  • Vertical height differentials of 1/2 inch or more between sidewalk sections
  • Cracks wider than 1/2 inch, or a network of cracks ("cracked, broken corners")
  • Improper slope or ponding of water on the sidewalk
  • Missing, cracked, or defective curb sections adjoining the sidewalk
  • Tree roots causing heaving or cracking of the sidewalk surface

What Happens If You Get a Violation

A DOT violation gives you a compliance deadline, typically 75 days, to make the repair. Miss it, and the city can perform the repair itself through its emergency repair program and bill the property owner — often at a significantly higher cost than hiring your own licensed contractor directly.

Permits Matter

Sidewalk repair in NYC requires a DOT permit before work begins, along with compliance with specific concrete specifications and curb requirements. Work done without a permit can be red-tagged, stopped mid-project, or require costly rework — which is why hiring a certified NYC Sidewalk Repair Contractor matters as much as the quality of the concrete itself.

The Big Apple Pothole Protection Program

New York City's Big Apple Pothole and Sidewalk Protection Program requires the city to maintain a map of reported defects. If a defect was reported and not repaired within the required timeframe, injured parties may be able to pursue a claim against the city instead of the property owner — but this is a narrow exception, not a substitute for regular maintenance.

Regular sidewalk maintenance is far less expensive than a DOT violation, an emergency repair bill, or a liability claim. TJ Construction is a certified NYC Sidewalk Repair Contractor, and we handle everything from the DOT permit to code-compliant concrete work across Brooklyn, Queens, Manhattan, Staten Island, and the Bronx.
